What is Bankruptcy?

What are the consequences?
Your debts are removed after 12 months of Bankruptcy. However, the Trustee may repossess and sell any assets that you own to pay your creditors.
As well as this, if you have any surplus income you may have to contribute this. This can be for up to 3 years, even after you are no longer Bankrupt.
After one year, you are discharged, debt-free. However, a Trustee has three years to realise assets you may hold, including your family home.
Can I keep my home?
For many, the family home is the most treasured asset. In Bankruptcy cases where there is value in your home, your Trustee will seek to repossess it. This can happen even if you jointly own the house with another person.

What is a trustee?
If you have assets worth more than £15,000, a Trustee will oversee the process. Their job is to realise (sell) your assets to pay off creditors.
They also take a fee based on a variety of factors including the value of your assets and the amount of work involved. These fees are paid from your Bankruptcy estate.
